1. Agreement to Terms
By accessing or using VYVE Wellness services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
2. Membership Terms
Eligibility
You must be at least 18 years old to purchase a membership. Minors aged 16-17 may use our facilities with parental consent and supervision.
Membership Fees
- Monthly fees are billed in advance on your enrollment date
- A one-time enrollment fee of ₹1,000 applies to all new members
- Prices are subject to change with 30 days' notice
- All fees are non-refundable except as outlined in our 30-day money-back guarantee
Cancellation Policy
- No lock-in contracts - cancel anytime with 30 days' written notice
- First-time members: 30-day money-back guarantee if not satisfied
- Cancellation requests must be submitted in writing or via email
- No refunds for partial months
3. Facility Rules and Usage
Code of Conduct
Members agree to:
- Respect other members and staff
- Maintain proper gym attire and hygiene
- Clean and return equipment after use
- Follow safety guidelines and trainer instructions
- Not use equipment while under the influence of alcohol or drugs
Class Bookings
- Classes can be booked up to 7 days in advance via the VYVE app
- Late cancellations (less than 2 hours before class) may result in booking restrictions
- Repeated no-shows may result in temporary suspension of booking privileges
4. Health and Safety
Medical Clearance
You confirm that you are physically able to participate in fitness activities. We recommend consulting a physician before beginning any exercise program, especially if you have pre-existing medical conditions.
Assumption of Risk
You acknowledge that physical exercise involves inherent risks of injury. You voluntarily assume all risks associated with your use of our facilities and participation in our programs.
5. Liability and Indemnification
VYVE Wellness, its employees, and contractors shall not be liable for any injury, loss, or damage to person or property arising from use of our facilities or services, except where caused by our gross negligence or willful misconduct.
You agree to indemnify and hold harmless VYVE Wellness from any claims arising from your use of our services or violation of these terms.
6. Café and Nutrition Services
- Menu items and prices are subject to change
- We cannot guarantee allergen-free preparation; please inform staff of allergies
- Meal subscription deliveries must be confirmed 24 hours in advance
- Perishable items are non-refundable
7. Intellectual Property
All content, including but not limited to text, graphics, logos, images, and software, is the property of VYVE Wellness and protected by copyright and trademark laws. Unauthorized use is prohibited.
8. Digital Services
Use of the VYVE Digital app and online services is subject to:
- Account security is your responsibility
- Sharing login credentials is prohibited
- We reserve the right to modify or discontinue features
- Service availability is not guaranteed 100% of the time
9. Suspension and Termination
We reserve the right to suspend or terminate your membership for:
- Non-payment of fees
- Violation of facility rules or code of conduct
- Harassment or abusive behavior toward staff or members
- Fraudulent activity or misuse of services
10. Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or posted notice at our facilities. Continued use of services after changes constitutes acceptance.
